1. Acceptance of Terms
By creating an account on PawSafe ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.
PawSafe is operated by Fail Safe Pet Care Limited ("we", "us", "our"), a company registered in New Zealand.
2. Description of Service
PawSafe is an emergency pet care coordination platform. It allows pet owners to:
Register their pets and care requirements
Nominate trusted emergency contacts ("carers")
Trigger emergency alerts that notify carers in a prioritised cascade when the owner is unable to care for their pets
PawSafe is a coordination tool only. It does not provide physical pet care, veterinary services, or emergency response services.
3. User Responsibilities
As a user of PawSafe, you agree to:
Provide accurate and up-to-date information about your pets, including medications, dietary needs, and veterinary details
Ensure your nominated emergency contacts are aware of and consent to being listed as carers
Keep your account credentials secure and not share them with others
Use the emergency alert feature only for genuine pet care emergencies
Not use the Service for any unlawful purpose
4. First Responder Liability Disclaimer
This is a critical clause. Please read it carefully.
PawSafe operates entirely independently of any emergency services, first responder organisations, or healthcare providers. There is no official agreement, partnership, or arrangement between PawSafe and any first responder organisation.
The following parties are NOT responsible or liable in any way for:
The care or welfare of pets during an owner emergency
Notifying the PawSafe service or any carer of an owner emergency
Any outcomes related to pet welfare during or following an emergency event
Interacting with, notifying, or using the PawSafe platform in any capacity
This disclaimer applies to, but is not limited to:
St John’s Ambulance Service (St John New Zealand) and all employees, volunteers, and contractors
New Zealand Police (Ngā Pirihimana o Aotearoa) and all employees, officers, and contractors
Fire and Emergency New Zealand (FENZ) and all employees, volunteers, and contractors
Hospital staff, including all District Health Boards, hospitals, medical centres, emergency departments, nurses, doctors, specialists, and healthcare workers
Any other first responder, emergency service, or healthcare organisation and their employees, agents, or representatives
No first responder organisation has any obligation to interact with, notify, or use PawSafe. The responsibility for triggering a PawSafe alert rests solely with the pet owner or their pre-nominated contacts.
5. Limitation of Liability
To the maximum extent permitted by New Zealand law:
PawSafe is provided "as is" without warranties of any kind, express or implied
We do not guarantee that alerts will be delivered, received, or acted upon
We are not liable for any loss, injury, or death of any pet arising from the use or inability to use the Service
We are not liable for any actions or inactions of nominated emergency contacts
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to use the Service in the 12 months preceding the claim
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the Consumer Guarantees Act 1993 or any other applicable New Zealand legislation.
6. Privacy & Data
By using PawSafe, you acknowledge that:
Your pet care information (medications, vet details, feeding schedules) will be shared with your nominated carers during an emergency alert
Your personal information (name, email) will be shared with carers you nominate
Alert history and response data is stored to maintain audit records
We store your data securely and will not sell or share it with third parties beyond what is necessary to operate the Service
Our data handling practices comply with the New Zealand Privacy Act 2020.
7. Carer Responsibilities
If you are nominated as an emergency carer by a PawSafe user:
You have no obligation to accept or respond to any alert
If you accept an alert, you agree to make reasonable efforts to care for the pets according to the instructions provided
You must not share the private care page link or any owner information with unauthorised third parties
8. Service Availability
We aim to provide reliable service but cannot guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any consequences arising from service downtime.
9. Modifications to Terms
We may update these Terms from time to time. When we make changes, we will update the version number and effective date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
10. Account Termination
You may close your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.
11. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes arising from the use of PawSafe shall be subject to the exclusive jurisdiction of the courts of New Zealand.
